Terms & Conditions of Sales

These terms and conditions (“Terms of Sale”) govern your order and purchase of any Goods through this Website https://tachikara.hk. By submitting your order on this Website, you agree to accept these Terms of Sale and to be legally bound by them. If you do not wish to accept these Terms of Sale, please do not submit any order through this Website.

TACHIKARA Hong Kong may amend these Terms of Sales from time to time and such amendment shall be deemed to be effective between you and us from such time as we post the amended Terms of Sales on the Website. Accordingly, you are advised to check these Terms of Sales each time you wish to order Goods on the Website to ensure you are aware of and understand the terms which will apply at that time.

TACHIKARA Hong Kong attempts to be as accurate as possible in relation to the information and content on the Website. However, TACHIKARA Hong Kong, to the maximum extent permitted by law, does not warrant or guarantee that the information and content on the Website is accurate, complete, up-to-date or error-free.

Definitions:

 In these Terms of Sale, the following words shall have the meanings set out below:

“TACHIKARA Hong Kong”, “we” or “our” means TACHIKARA Hong Kong.

“Contract” means a contract agreed by you and TACHIKARA Hong Kong on the sale or supply of Goods pursuant to these Terms of Sale.

“Goods” means any goods or products offered for sale on this Website from TACHIKARA Hong Kong, including but not limited to, accessories, supplies, parts, multi-function centers, printers, facsimile machines and sewing machines.

“Website” means www.tachikara.hk.

 “You” means you or any persons who order Goods through this Website from TACHIKARA Hong Kong.

Order Confirmation/Acceptance:

After you place an order to purchase Goods from TACHIKARA Hong Kong through the Website shopping cart, you will receive an e-mail of invoice and delivery note from TACHIKARA Hong Kong confirming receipt of your order. Your receipt of such email, however, does not signify TACHIKARA Hong Kong’s acceptance of your order, nor does it constitute confirmation of our offer to sell.    While we generally will use our best effort to satisfy your order, we may choose not to accept any order or limit any order quantity due to shortage of stock, pricing or other errors, failure to verify or process payment or for any other reasons, even if you have made payment to Tachikara Hong Kong. TACHIKARA Hong Kong may require additional qualifying information prior to accepting or processing any order.

If TACHIKARA Hong Kong declines your order, TACHIKARA Hong Kong will notify you using the e-mail address you provided during your registration onto this Website or by phone within two working days after you placed the order. If payment was made and your order is cancelled, TACHIKARA Hong Kong will refund the appropriate amount of the charge to you by cheque.

If you do not receive any email or phone call from TACHIKARA Hong Kong informing you the cancellation of your order within 2 working days after you placed the order, your order is deemed to be accepted by TACHIKARA Hong Kong.

Payment:

Payment for the products shall be made in full before physical delivery of the Goods.

TACHIKARA Hong Kong reserves the right to correct pricing errors that may inadvertently occur. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you

You may pay for your order of the Goods with a major credit card issued in Hong Kong, with billing address in Hong Kong. Currently, we accept PayPal, Visa and MasterCard.

You hereby represent and warrant that you are the legitimate holder or authorized user of the credit card that you use for payment of the Goods.

Delivery:

All orders placed on the Website are subject to product availability and will be delivered according to TACHIKARA Hong Kong’s shipping policy.

TACHIKARA Hong Kong will use its reasonable endeavors to deliver the goods to you on the delivery date that we notify to you. Since the actual delivery of your order can be impacted by many events beyond our control once it leaves our facilities, we shall not be liable for any delay in delivery of the Goods.

Return Policy:

   All sales made through the Website are subject to TACHIKARA Hong Kong's return policy. For more details please check our return policy.

Children:

  TACHIKARA Hong Kong does not sell products to children. If you are under 18 years old, you shall only use the Website under the supervision of a parent or guardian.

 

Governing Law:

 These Terms of Sale shall be governed by and construed in accordance with the laws of Hong Kong and each party hereby submits to the non-exclusive jurisdiction of the courts of Hong Kong in relation to any dispute arising under or in connection with these Terms of Sale.

General:

In the event that any of the provisions in these Terms of Sale are held by a court or other tribunal of competent jurisdiction to be void or for any reason unenforceable, then that provision shall be limited or eliminated to the minimum extent necessary and such provision shall be deemed severable from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions.

In case of any discrepancy occurring between the Chinese and the English versions of the Terms and Conditions, the English version shall prevail.

 本銷售條款及細則(以下簡稱「銷售條款」)適用於任何透過本網站 https://tachikara.hk 訂購和採購的商品。顧客在本網站提交訂單後，即會被視為同意接受本銷售條款並受其約束。如顧客不同意接受本銷售條款，請勿於本站提交任何訂單。 

 

   TACHIKARA Hong Kong 擁有隨時修訂本銷售條款的權利。修訂後的銷售條款一經網站公佈，修訂便會對顧客和TACHIKARA Hong Kong同時生效。因此，本公司建議每次於網站訂購商品前，請先查詢網站內的銷售條款，以確保已得悉及充分瞭解當時適用的條款。 

  TACHIKARA Hong Kong會儘量確保網站內的資訊和內容皆為準確。但是在法律允許的最大範圍內，TACHIKARA Hong Kong不會對網站資訊和內容的準確性、完整性、及時性和正確性作出任何擔保或保證。 

 

定義:  

 以下用語在本銷售條款中的定義如下：

「TACHIKARA Hong Kong」、「我們」或「本公司」是指TACHIKARA Hong Kong。 

「合約」是指顧客與TACHIKARA Hong Kong根據本銷售條款達成的商品銷售或供應合同。 

 

確認接受訂單:

 在透過網站購物車訂購TACHIKARA Hong Kong的商品後，將會透過電郵收到TACHIKARA Hong Kong的確認電郵，確認已經收到顧客的訂單。然而，此類電郵並不代表TACHIKARA Hong Kong已經接受訂單，亦不代表本公司已確認進行銷售。在一般情況下，本公司會盡力滿足顧客的訂購要求。但是，即便 顧客已經向TACHIKARA Hong Kong支付相應款項，我們可能因庫存不足、價格或其他錯誤、確認或處理支付出現故障或任何其他原因而拒絕接受部分訂單或限制部分訂單的訂購數量。在接受或處理任何訂單前，本公司可能要求提供其他相關資料。

 如TACHIKARA Hong Kong拒絕接受訂單，本公司將在下訂單後的三個工作天內，通過顧客在本網站註冊時提供的電郵位址或以電話方式通知。如顧客已經付款而訂單又遭取消，TACHIKARA Hong Kong將退還已經支付的金額。

 如在確認訂單後的三個工作天內沒有收到TACHIKARA Hong Kong發出的電郵或電話告知訂單已被取消，則表示 TACHIKARA Hong Kong已接受訂單。

 

付款:

 顧客應在商品實際送抵前支付所有金額。TACHIKARA Hong Kong將保留更正因疏忽而導致價格出錯的權利。如出現價格錯誤，本公司會通知顧客。顧客可以選擇按照正確價格繼續交易或在無需承擔任何費用的條件下取消訂單。

 顧客可以使用由香港幾間主要銀行簽發、而且收取帳單的地址位於香港內的信用卡支付訂購商品的款項。我們目前接受Paypal, MasterCard 和Visa付款。在此聲明並保證，他/她是該支付商品款項的信用卡的合法持卡人或授權使用人。

 

擁有權及風險:

 本公司收到顧客的全額付款或當商品從本公司發出後，商品的擁有權即轉交予顧客（以時間較晚者為準）。當商品送達顧客指定的地點後，則由顧客承擔遺失商品的風險。

 

送貨:

 所有網站訂單均需視乎存貨情況而定，並根據TACHIKARA Hong Kong的配送政策交收。TACHIKARA Hong Kong會致力使顧客在本公司通知的交貨時間收到商品。因在發送商品後，實際交貨時可能受 到眾多無法控制的因素所影響，本公司將不就商品交付時間的延誤承擔任何責任。

 

退換政策:

兒童:

 本銷售條款適用香港特別行政區的法律及根據其釋義，對於在本銷售條款下產生或與本銷售條款相關的任 何爭議，雙方同意接受香港特別行政區法院的非專屬性管轄。

一般條款:

 如本銷售條款的任何條款被法院或其他具有管轄權的法庭裁定為無效或因任何原因而無法執行，應在最小而必要的程度內限制或刪除此類條款，而此類條款可視為獨立於本銷售條款外，不得影響其他條款的有效性和可行性。
